Your Content and Our Licence

When we say ‘your content’ in these terms, we mean all the things you add (create, upload, post, share, etc.) to the AIGAGA Platform. This includes text, links, photos, objects, models, videos, documents or other media.

You are not obligated to upload, create, edit, or publish Content to AIGAGA. If you decide to add content to the Platform, you are responsible for ensuring that you have the right to do so, that you have the right to grant the licences in this section of these terms and that your content is lawful. We take no responsibility for any of your content, and we are not responsible for others' use of your content. You may refer to AIGAGA.com/trademark, and AIGAGA.com/copyright for more information.

Our Services allow users to add and create content in a number of different ways, including uploads, image creation, image conversion to Spaces, Universes or Multi- verses. Unless otherwise stipulated as Private or Secret a Space or Universe and all the Content may be accessed by the public at large.

When creating, publishing or posting in a Space consider the right space, features and settings for you and your content. When publishing to a Universe your Content cannot be edited, or removed, and will be displayed openly.

AIGAGA USE OF CONTENT

As between you and AIGAGA, AIGAGA owns the Content, including Inputs and Outputs that you generate using the Services to the extent permitted by applicable law. Please be aware that any image you make in a shared or open space, such as a universe, is viewable by anyone online and other users may use or remix your Content whenever it is posted in a shared or open space.

As part of improving the quality of the Services and our generative AI tools, we may collect from you the following content (collectively, “Collected Content”):

Prompts (or Inputs)
Generated Imagery in 2D or 3D, Audio, Music, Video (multimedia, and ChatBot (or Outputs)
Aesthetic feedback/ratings
A rating survey taken on initial signup, which is used to provide dataset users with a synthetic identity and profile of a user's aesthetic preferences and rating habits
Whether a generated image was chosen to be upscaled
Whether a user is a verified contributor to the Services
The specific methods used to generate and upscale images, as these will change over time

We may also collect other data as discussed elsewhere in these Terms.

By using the Services, you grant to us, our successors, and assigns a perpetual, worldwide, non-exclusive, sublicensable, no-charge, royalty-free, irrevocable copyright license to reproduce, prepare Derivative Works of, publicly display, publicly perform, sublicense, and distribute the Collected Content. This license survives termination of this Agreement by any party for any reason.

Unless otherwise expressly indicated by AIGAGA, all content displayed or made available on the Site, including without limitation, text, images, illustrations, designs, logos, domain names, service marks, software, scripts, and the selection, compilation and arrangement of any of the foregoing is owned by AIGAGA, its affiliates, licensors and/or other third parties (“Site Content”). The Site and all Site Content are protected by copyright, trade dress, trademark, moral rights, and other intellectual property laws in the United States, Canada, the United Kingdom, EU, and other international jurisdictions. All rights are reserved.

All registered and unregistered trademarks, logos, and service marks are the property of AIGAGA and/or their respective owners. Nothing displayed or accessed in connection with the Site shall be construed as granting by implication, estoppel, or otherwise, any license or right to use any trademark, logo, or service mark displayed in connection with the Site without the owner's prior written permission, except as otherwise described herein.

We may, in our sole discretion, make the Collected Content available under a CC0 1.0 Universal Public Domain Dedication license (available at https://creativecommons.org/publicdomain/zero/1.0/) (the “License”). If we are to release your Content under the License, the Content would be public domain and can be used by anyone for any purpose, including by the user.

With respect to images you upload to AIGAGA.com you represent and warrant that you own all rights, titles, and interests in and to such images, including, without limitation, all copyrights and rights of publicity contained therein. You are responsible for the Content, including ensuring any Content Sharing does not violate any applicable law, intellectual property right of any third party, or these Terms.

Without limiting the foregoing, you acknowledge and agree that AIGAGA may preserve your Inputs and Content and may also disclose your Inputs and Content if required to do so by law or in AIGAGA's good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process, applicable laws or government requests; (b) enforce these Terms; (c) respond to claims that any Content violates the rights of third parties; or (d) protect the rights, property, or personal safety of AIGAGA, its officers, employees, directors, shareholders, licensors, service providers, agents, and the public.

You own your content, but when you use AIGAGA.com, you grant us a license to use it. This means you give us permission to:

Use and Share: Store, copy, and share your content to make our services work. For example, we need this permission to display your creations in the virtual multiverse.
Publish and Promote: Publish and share your content if you've chosen to make it visible to others. This allows us to show your creations to other users and recommend them within the community.
Adapt and Improve: Modify, translate, and reformat your content to work seamlessly with our services. For example, we may resize images to fit different devices.
Work with Partners: Share your content with our partners, such as cloud storage providers, to ensure our services function correctly.

This license allows us to use your content to operate and improve our services. It's:

Worldwide: We can use your content anywhere in the world.
Royalty-free: We don't have to pay you to use your content.
Perpetual: This license lasts forever.
Non-exclusive: You can still grant licenses to others for your content.

Content Removal

Clarity: AIGAGA reserves the right to remove content that violates terms, guidelines, or laws, or poses risks to the platform or its users.
Specificity: Consider adding examples of content that might be removed, such as content that is harmful, abusive, or infringing.
User-friendliness: You could rephrase “negatively impacts the experience or interests of other Discord users to continue to make it available” to something like “harms other users or the AIGAGA community.”

Our Content

We own all the content that makes up our services, including the design of our apps and websites, our artwork, images, and written materials. You can use our software as described in these terms, but you can't use our trademarks or other branding without our permission (except as allowed in our Copyright and Trademark sections)

Other People's Content

You will see content created by other people on AIGAGA. Remember that you can't use their content without their permission or as allowed by law. The views and opinions expressed in other users' content are theirs alone and don't necessarily reflect those of AIGAGA.

While we strive to make AIGAGA a safe and positive space, we can't guarantee that you won't encounter content you find objectionable. You agree that we're not responsible for any harm caused by other users' content.

If you see content that violates our policies, please report it to us. Please refer to our Acceptable Use Policy. We may review these reports and take action, such as removing the content, at our discretion.

Third-Party Content and Features

AIGAGA may provide links to third-party websites, apps, or other content for your convenience. However, we're not responsible for the content or services offered by these third parties.
